Terms and conditions for using CareVoice

1. Acceptance of Terms

By accessing or using CareVoice, you agree to be bound by these Terms of Use. If you do not agree to all the terms and conditions, you may not use this service. CareVoice reserves the right to modify these terms at any time by posting updated terms on this page. Your continued use of the service constitutes acceptance of any changes.

2. Description of Service

CareVoice is an Australian software application designed for NDIS support workers and care providers. The service enables users to generate compliant NDIS invoices from voice recordings. You can record voice notes about care activities, and the app uses AI to convert those recordings into structured progress notes and billing information. Invoices are then generated based on this data and can be exported as PDF documents.

4.2 Apple App Store Subscriptions

If you purchase a subscription through the Apple App Store, your payment is processed by Apple. Your subscription is auto-renewable, which means it will automatically renew at the end of each billing period unless you cancel it. You can manage, view, and cancel your subscription through your Apple Account Settings or App Store Settings on your Apple device. Apple is responsible for processing all payments, and refunds are governed by Apple's App Store refund policy.

4.3 Billing and Cancellation

Subscription charges are billed to your Apple Account on the selected billing date. If a payment fails, Apple will attempt to charge your account again. If payment fails after multiple attempts, your subscription may be suspended. You can cancel your subscription at any time through your Apple Account Settings. Cancellation will take effect at the end of your current billing period, and you will not receive a refund for the current period.

5. Intellectual Property

All content, features, and functionality of CareVoice including the software, design, text, graphics, and all other materials are the exclusive property of CareVoice or its content suppliers. You retain ownership of any data you input into the application (such as participant names, invoice details, and recordings). However, you grant CareVoice a limited license to process your voice recordings and generate progress notes as part of the service. The progress notes and insights generated by the app may be considered derivative works, but your underlying data remains your property. You may not copy, modify, distribute, transmit, or create derivative works of the CareVoice software without express written permission.

6. Limitation of Liability

CareVoice is provided on an "as-is" and "as-available" basis. To the fullest extent permitted by law, CareVoice makes no warranties, express or implied, regarding the service. CareVoice does not guarantee that the service will be error-free, uninterrupted, or secure. You assume all responsibility for the consequences of using the service, including the accuracy of generated invoices and compliance with NDIS regulations.

To the extent permitted by Australian law, CareVoice shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the service, including but not limited to loss of revenue, loss of data, or business interruption, even if CareVoice has been advised of the possibility of such damages.

7. Termination

CareVoice may terminate or suspend your account and access to the service at any time, with or without cause, and with or without notice, if you violate these Terms of Use or engage in any conduct that CareVoice believes, in its sole discretion, is harmful to the service, other users, or CareVoice itself. Upon termination, your right to use the service ceases immediately. You remain responsible for any charges incurred prior to termination.

8. Governing Law and Jurisdiction

These Terms of Use are governed by and construed in accordance with the laws of Australia, and you agree to submit to the exclusive jurisdiction of the courts of Australia. If any provision of these terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

9. Apple App Store Terms

If you are using CareVoice via the Apple App Store, you also agree to comply with Apple's Standard End-User License Agreement (EULA). In the event of any conflict between these Terms of Use and Apple's EULA, Apple's terms will apply with respect to Apple's services.
